Re: Investigation into ATN-Sunrise on 4 July 2007 and The Morning Show on 5 July 2007

Thank you for your letter received by the Australian Communications and Media Authority (ACMA) on 30 November 2007 concerning ACMA’s investigation into ATN’s broadcasts of Sunrise on 4 July 2007 and The Morning Show on 5 July 2007.

I note your concerns that ACMA’s investigations of your complaint is not comprehensive in that it will not consider all the issues you have raised in relation to the above broadcast.

The role of ACMA is to regulate the broadcasting industry. ACMA assesses licensees’ and national broadcasters’ compliance with provisions of the industry codes of practice and conditions under the Broadcasting Services Act 1992 (the Act). To that extent, ACMA is able to investigate only those matters that relate either to a potential breach of a code of practice, licence condition or provision of the Act.

 As per ACMA’s letter dated 3 October 2007, a number of issues you have raised do not fall within ACMA’s jurisdiction. I have enclosed a copy of this letter for your information. In relation to the investigation of your complaints that do fall under the Commercial Television Industry Code of Practice 2004 (the Code), ACMA will have regard to the correspondence you have provided.

I note that in your letter of 13 September 2007 to ACMA you state that you were not happy with Channel 7’s response and requested ACMA to investigate. The correspondence between you and Channel 7 refers to both Sunrise (broadcast on 4 July 2007) and The Morning Show (broadcast on 5 July 2007) and accordingly, ACMA will be considering both broadcasts.

ACMA has enough information before it to consider your Code complaint and you will be advised of ACMA’s findings when the investigation is finalised.
